Navigating the Rules: Key Steps To Be Compliant

Staying Compliant: A Short-Term Rental Owner’s Guide to Regulations on Florida’s Space & Treasure Coasts

Owning a short-term vacation rental on Florida’s Space Coast—home to Cocoa Beach, Cape Canaveral, and a growing tourism economy—can be a great investment. But alongside the opportunity comes a responsibility: staying compliant with local and state regulations. Failing to do so can result in fines, legal trouble, or even being shut down. Here’s what every STR (short-term rental) owner needs to know to stay on the right side of the law.

On top of it, the rules have changed. Below is a guide to help you interpret the rules so you can be onside with all of the necessary regulations. Becoming and staying compliant can be a process, and should you have questions, we are here to help. Please know, that if Happy Palm Stays is managing your property, this has all been taken care of for you.

FYI – New Cocoa Beach Ordinance

Effective March 2025, the Cocoa Beach City Commission passed
Ordinance 1695 – solidifying new rules across the city for all short-term vacation rentals. This impacts how you register your property, occupancy limits, fees, fines, and more.

  • All Cocoa Beach properties need to be registered – All short-term rentals (STRs) need to be registered with the city (previously only single-family homes). Each rental requires 1) a “Vacation Rental Certificate,” 2) a “Business Tax Receipt,” and 3) a local emergency contact.
  • Annual fees have increased – For a condo or multi-family unit, the annual fee is $146.30 × the approved guest capacity. For a single-family home, the annual fee is $219.45 × the approved guest capacity.
  • Guest occupancy rules have changed – The new formula is 2 guests per bedroom + 2 extra. A 5-bedroom house, for example, may host 12 occupants.
  • Fines for non-compliance have increased – Owners are subject to fines of up to $1,000/day for operating without valid registration.

Common FAQ's

  • I’m interested in buying a property, but do not know if short term rentals are allowed, how should I confirm what is permitted?

Given eligibility varies by City & HOA, the easiest thing to do is ask us. Email compliance@happypalmstays.com or call (321) 587-0869 and we will let you know.

  • How can I check to see if my property is registered correctly (either by myself or property manager)?

Contact the City you are located in and they can confirm. We also have direct relationships with City Officials from Cape Canaveral & Cocoa Beach down to Melbourne Beach & Vero Beach. If you would like us to ask on your behalf, just ask.

  • What is the fine for non-compliance?

Fines vary depending on the city you operate in. For example, in Cocoa Beach the initial fine is $250 per day, but quickly escalate to up to $1,000 per day. It’s expensive, so please get registered!

  • Does my property manager do this for me?

This depends on who is managing your property. If you self-manage, it is your responsibility. If you have a property manager, we recommend confirming compliance with the City. We have found numerous cases where a property owner thought they were compliant, when in fact the property manager did not offer this service automatically. At Happy Palm Stays, all properties are automatically registered by our compliance team.

  • How do I collect and remit taxes?

Hosts must collect and remit taxes. While some OTA’s collect this on your behalf, others do not. You are also responsible for collecting and remitting taxes for all direct rentals. There is an online platform for submitting both. All rentals in Brevard County are subject to a 7% Florida Sales Tax and a 5% Brevard County Tourist Development Tax.

  • I am located in the “Unincorporated Area” of Brevard, what does this mean?

Unincorporated Brevard allows short-term rentals in specific zoning areas. We recommend confirming compliance with the Brevard County Planning and Development Department to ensure your property is eligible. You’re also welcome to email us at compliance@happypalmstays.com or call (321) 587-0869, and we’ll be happy to help you determine your property's eligibility.

  • Does my property need to be inspected by the fire department?

It depends on where your property is located, for example in Cocoa Beach & Cape Canaveral it is required for certain property types, whereas in St. Lucie County, it is not.

  • Is the City actually checking and ‘cracking down’?

The short answer is yes. However regardless, it is the responsible thing to do and ensures that operators are acting responsibly and respectfully in the community. Therefore, we strongly suggest that if you are going to rent your property short term, that you follow all applicable rules.
